Welcome to ARTPLUGSHOP.COM. The terms we us and our refer to ArtPlug LLC trading as THE ART PLUG SHOP. We operate this website and store including all information content features tools products and services to provide you with a curated shopping experience the Services. Our store is powered by Shopify which enables the Services.

These Terms of Service the Terms together with the policies referenced here describe your rights and responsibilities when you use the Services. By visiting interacting with or purchasing through the Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree do not use the Services.

1. Access and account

You confirm that you are at least the age of majority in your place of residence and that you have authority to use any device or payment method used on the Services. You may be asked to provide information such as email address billing payment and shipping details. You represent that all information you provide is accurate current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You may not sell assign or transfer your account.

2. Our products

We make every effort to display products accurately. Colors and appearance may vary due to device settings and lighting. We do not warrant that any product will meet your expectations or match on screen previews exactly. Descriptions and pricing may change without notice. We may discontinue products and limit quantities by person region or order at our discretion.

Most items are created to order as part of limited editions. Availability is not guaranteed until purchase is completed.

3. Orders

Your order is an offer to buy. We may accept or decline any order at our discretion. An order is accepted when we confirm acceptance and process payment. Review your order carefully before submitting as cancellations may not be possible once accepted. If we cannot accept change or must cancel an order we will attempt to notify you at the email billing address or phone you provided.

Purchases are subject to our Return and Refund Policy. You represent that your purchases are for personal or household use and not for commercial resale or export.

4. Prices and billing

Prices discounts and promotions may change without notice. The price charged is the price in effect when the order is placed and appears in your confirmation email. Unless stated otherwise prices exclude taxes shipping handling customs and import charges. Promotions may have separate terms which control if they conflict with these Terms.

You agree to provide current complete and accurate purchase and account information and to promptly update your details including email payment method and expiration dates so we can complete transactions and contact you as needed. You represent that you are authorized to use the payment method and that charges will be honored and paid including applicable taxes fees and shipping.

5. Shipping and delivery

All items are produced to order. Production typically takes the timeframes stated in our Shipping Policy. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers customs or events outside our control. Title and risk of loss pass to you when we hand off to the carrier.

6. Intellectual property

The Services and all content including text images graphics logos product designs video and audio and the design selection and arrangement are owned by ArtPlug LLC and its licensors and are protected by intellectual property laws. You may use the Services for personal non commercial use only. You may not copy reproduce distribute modify create derivative works display perform republish download store or transmit any material without prior written consent except as allowed by law. All rights not expressly granted are reserved.

THE ART PLUG SHOP and related names logos product names designs and slogans are trademarks of ArtPlug LLC or its affiliates or licensors. Shopify names and marks are trademarks of Shopify. Other names and marks are the property of their respective owners.

7. Optional tools and new features

We may provide access to tools or features offered by third parties. We provide these as is and as available without warranties representations or conditions and without endorsement. Use is at your own risk and subject to third party terms. Future features resources or tools will form part of the Services and be subject to these Terms.

8. Third party links

The Services may contain links to third party sites or content. We do not control and are not responsible for third party sites or materials. Access is at your own risk. Review third party terms and policies before any transaction. Complaints claims or questions about third party products or services should be directed to the third party.

9. Relationship with Shopify

Our store is powered by Shopify. Purchases are made directly with ArtPlug LLC. Shopify is not responsible for any sales between you and ArtPlug LLC and you release Shopify and its affiliates from claims damages and liabilities arising from or related to your transactions with us.

10. Privacy

Personal information collected through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify some personal information is processed by Shopify and its subprocessors which may include international transfers. See the Shopify Privacy Policy for details.

11. Feedback and reviews

If you submit ideas suggestions reviews or other content Feedback you grant us a perpetual worldwide sublicensable royalty free license to use reproduce modify publish distribute and display the Feedback in any medium for any purpose including to operate enhance and promote the Services. You represent that you have all rights to grant this license and that your Feedback complies with law and these Terms. We may monitor edit or remove Feedback at our discretion.

12. Errors inaccuracies and omissions

Information on the Services may contain errors or omissions including in descriptions pricing promotions shipping charges transit times and availability. We reserve the right to correct update or cancel orders if any information is inaccurate at any time without notice including after you submit an order.

To the fullest extent permitted by law ArtPlug LLC and its partners directors officers employees affiliates agents contractors service providers and licensors and Shopify and its affiliates will not be liable for any indirect incidental special consequential or punitive damages including lost profits lost revenue lost savings loss of data replacement costs or similar damages arising from or related to your use of the Services or any products even if advised of the possibility. In no event will our total liability for all claims exceed the amount you paid for the product or one hundred US dollars whichever is greater. Some jurisdictions do not allow certain limitations so some limitations may not apply to you.

17. Indemnification

You agree to indemnify defend and hold harmless ArtPlug LLC Shopify and our respective affiliates officers directors employees agents contractors licensors and service providers from losses damages liabilities claims and costs including reasonable attorneys fees arising out of your breach of these Terms violation of law or rights of a third party or misuse of the Services. We will notify you of any claim and may control the defense and settlement. You will cooperate in the defense.

18. Force majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control including acts of God labor disputes shortages pandemic war terrorism civil disorder governmental action interruptions of the Internet or utilities or failures of suppliers or carriers.

19. Severability

If any provision of these Terms is unlawful void or unenforceable that provision will be enforced to the maximum extent permitted and the remainder will remain in effect.

20. Waiver and entire agreement

Our failure to enforce any right is not a waiver. These Terms together with policies posted on the site are the entire agreement between you and us and supersede prior agreements regarding the Services. Any ambiguities will not be construed against the drafting party.

21. Assignment

You may not assign transfer or delegate your rights or obligations without our prior written consent. We may assign transfer or delegate these Terms without notice.

22. Governing law and venue

These Terms and any disputes arising from or related to the Services are governed by the laws of the State of Florida without regard to conflict of law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Miami Dade County Florida subject to any consumer rights that require local jurisdiction.
